Terms & Conditions of Sale

Applicable to RGL SARL professional sales (Nonna Luisa Food Service). By confirming an order, the pro client acknowledges having read and accepts the present terms without reservation.

Article 1 — Purpose and scope

These Terms & Conditions of Sale govern the relationship between RGL SARL, a SARL with €1,000 share capital, registered office 2 rue Massena 06000 Nice, SIRET 808 745 152 00013, VAT FR76 808 745 152 (hereinafter "the Seller" or "Nonna Luisa Food Service"), and any legal entity (hereinafter "the Buyer") placing an order on pro.lanonnaluisa.com.

This site is reserved for professionals. Any individual acting for personal needs is excluded from the scope of these terms.

Article 2 — Products and pricing

The products offered are those listed in the online catalogue, subject to stock availability at our partner workshop in Cortemilia (Piemonte, Italy).

Prices are shown in euros exclusive of tax (excl. VAT) in the catalogue. The applicable French VAT is added on the final invoice: 5.5% on food products (art. 278-0 bis French Tax Code) and 20% on shipping and ancillary services. Prices are expressed in EUR/kg and vary by three volume tiers:

  • Tier 1 : up to 99 kg — standard price
  • Tier 2 : 100 to 399 kg — discounted price
  • Tier 3 : 400 kg and above — best price

Transport costs from Italy are added on a weight-based scale (from 50 EUR for 50 kg to 160 EUR for 600 kg). The Seller reserves the right to modify pricing at any time; products will be invoiced based on the rates in effect when the order is registered.

Article 3 — Minimum order

The minimum order is set at 5 kg of products (excluding transport). Any smaller order will be rejected automatically by the system.

Article 4 — Ordering

Orders are placed via the site after creation of a valid pro account (SIRET verified, intra-EU VAT validated via VIES). The Seller reserves the right to refuse any order on legitimate grounds, including doubt over the validity of the information provided, prior dispute, or extended stock shortage at the producer.

The order is only definitively recorded after payment confirmation. A confirmation email with PDF invoice is sent to the Buyer.

Article 5 — Payment

Payment is made online at the time of order, via our secure provider Stripe (PCI-DSS Level 1 compliant). Accepted payment methods are:

  • Bank card (Visa, Mastercard, CB)
  • SEPA direct debit (5-14 business day confirmation delay)

For large recurring orders, payment by transfer with negotiated terms may be granted after validation by the Seller.

Article 6 — Delivery

Products are shipped directly from our partner workshop in Cortemilia (Piemonte, Italy) to the address indicated by the Buyer in metropolitan France.

Standard delivery time is 4 to 6 business days from payment confirmation. This timing is indicative only; a delay cannot give rise to cancellation, product rejection or damages, save in case of serious Seller fault.

Risk transfers upon handover to the carrier. Upon receipt, the Buyer must verify product conformity and raise any reservations in writing on the delivery note, then confirm by email within 8 days.

Article 7 — Claims and returns

Any claim for non-conformity or damage must be made in writing within 8 days of receipt, to info@lanonnaluisa.com, with photos of the products and packaging.

No return will be accepted without prior written authorisation from the Seller. In case of confirmed non-conformity, the Seller will replace the products or refund, at its sole discretion.

As products are food items, no return for mere convenience is accepted.

Article 8 — Liability

The Seller does everything possible to guarantee product quality. Its liability is limited to best-efforts obligations and is, in any case, capped at the excl. VAT amount of the order concerned.

The Seller cannot be held responsible for indirect damages, loss of earnings, loss of customers or commercial prejudice.

Article 9 — Allergens

The products offered contain tree nuts (hazelnuts, almonds, pistachios, walnuts, pecan, macadamia, pine nuts). They may contain traces of other tree nuts. Product sheets detail allergens in accordance with EU Regulation 1169/2011 (INCO). It is up to the Buyer to pass this information on to its own end customers.

Article 10 — Late payment penalties

In case of late payment, a penalty equal to three times the legal interest rate is due by right, without a reminder being necessary, as well as a fixed 40 EUR collection fee (articles L441-10 and D441-5 of the French Commercial Code). No discount is granted for early payment.

Article 11 — Force majeure

The Seller's liability cannot be engaged in case of a force majeure event within the meaning of article 1218 of the French Civil Code (natural disaster, strike, pandemic, supply disruption at the producer, etc.). The Seller will inform the Buyer as soon as possible.

Article 12 — Applicable law and jurisdiction

These terms are governed by French law. Any dispute relating to their interpretation or execution falls within the exclusive jurisdiction of the Nice Commercial Court, notwithstanding plurality of defendants or third-party claims.
